Prosecutors have ordered the indictment of 6 individuals in the case of the train collision with Bus No. 206 at the Makkasan intersection, which claimed 8 lives and left more than 30 injured. Heavy charges have been filed against the train driver, the crossing guard, and the bus driver on grounds of negligence causing the death of others. The train driver faces an additional charge of drug use. Three other suspects — a motorcycle rider and pickup truck drivers — have been charged with obstructing rail transport after parking their vehicles straddling the yellow cross-hatched markings.
In the tragedy involving freight train No. 2126, which crashed into air-conditioned Bus No. 206 on Asok–Din Daeng Road near the railway level crossing close to the Makkasan Airport Rail Link station, Makkasan sub-district, Ratchathewi district, Bangkok, on 16 May 2026, 8 people were killed and more than 30 were injured.
Today (16 August), it has been reported that the investigation team, case file No. 117/2026, acting under orders from Metropolitan Police Division 1, Bangkok Metropolitan Police Bureau, completed its summary of findings with an opinion to prosecute the suspects, and submitted the case file to the public prosecutor on 24 July 2026. The public prosecutor subsequently ordered the indictment of all suspects before the court.
Mr. Sayomporn [surname withheld], the train driver, Suspect No. 1, has been indicted on charges of "acting negligently, causing the death of others, causing serious bodily harm to others, and causing bodily harm to others, and unlawfully consuming a Category 1 narcotic substance (methamphetamine)," constituting offences under Sections 291, 300, and 390 of the Criminal Code as amended by the Criminal Code Amendment Act (No. 26) 2017, and under Sections 104 and 162 of the Narcotics Code 2021.
Mr. Uthen [surname withheld], the crossing guard, Suspect No. 2, has been indicted on charges of "acting negligently, causing the death of others, causing serious bodily harm to others, and causing bodily harm to others," constituting offences under Sections 291, 300, and 390 of the Criminal Code as amended by the Criminal Code Amendment Act (No. 26) 2017.
Mr. Laphit [surname withheld], the bus driver, Suspect No. 3, has been indicted on charges of "driving negligently, causing the death of others, causing serious bodily harm to others, and causing bodily harm to others, and acting in any manner that constitutes obstruction of rail transport," constituting offences under Sections 291, 300, and 390 of the Criminal Code as amended by the Criminal Code Amendment Act (No. 26) 2017, and under Section 140 of the Rail Transport Act 2025.
Suspects No. 4 through 6 comprise the riders and drivers of a motorcycle and pickup trucks who parked their vehicles straddling the no-straddling markings at the railway crossing (yellow cross-hatched lines). The Department of Rail Transport authorised the Director of the Department of Rail Transport's Legal Division to file complaints against them, and they have been indicted on the following charges:

Mr. Saksri [surname withheld], the pickup truck driver, Suspect No. 5, has been indicted on charges of "driving negligently, causing serious bodily harm to others and bodily harm to others, and acting in any manner that constitutes obstruction of rail transport," constituting offences under Sections 300 and 390 of the Criminal Code as amended by the Criminal Code Amendment Act (No. 26) 2017, and under Section 140 of the Rail Transport Act 2025.
Mr. Aman [surname withheld], the motorcycle rider, Suspect No. 6, has been indicted on charges of "driving negligently, causing bodily harm to others, and acting in any manner that constitutes obstruction of rail transport," constituting offences under Section 390 of the Criminal Code as amended by the Criminal Code Amendment Act (No. 26) 2017, and under Section 140 of the Rail Transport Act 2025.
As for drivers who violated the Land Traffic Act 1979, which constitutes an offence under the Civil Fine Act 2022, the investigation team will summon those drivers to face legal proceedings accordingly.
